Not only residents of Kazakhstan will be able to buy agricultural lands at a discount
After two and a half months in Kazakhstan will come into force amendments to the Land Code, and thus, leased agricultural lands can be bought at auctions. At the same time the cadastral value of land can be reduced to 50%. Vice-Minister of National Economy Kayrat Uskenbaev commented in detail some emerging issues at a briefing at the Service of Central Communications, stressing that "this matter has caused great concern among the citizens of Kazakhstan".
"From July 1 agricultural land will be sold at auctions. Naturally, our citizens ask the question: Can it happen that people will come from a large state or foreign investors and will buy all the land", - said Uskenbaev.
As an answer to this question, Vice Minister read clause 1 of the article 24 of the Land Code, which "clearly states that foreigners and stateless persons, legal bodies, as well as a legal entity in the authorized capital of which the proportion of persons without citizenship of the Republic of Kazakhstan is more than 50%, may possess agricultural land only on the right of temporary use of land for up to 25 years".
"There is no other law for use of agricultural lands. No one can buy one millimeter or a centimeter of Kazakh agricultural land. Land Code and other legislative acts don’t give you such a right, and we do not have such a precedent ", - assured the vice-minister.
However, answering the following questions of the journalists, Kayrat Uskenbaev noted that, if the proportion of stateless persons is less than 50%, for example 49%, the "foreign party shall be entitled to participate in the joint venture”. And the joint venture has the right to be the owner of the land. If the ratio (non-residents of the Republic of Kazakhstan) changes, the Kazakh side sells 2% and the remaining 51%, then within three months the joint venture must re-register the right of lease of the land for 25 years", - explained Uskenbaev.
At the same a physical person or a legal entity, which already rents one or the other piece of land has the right to become its owner at any time through the rental contract for 49 years. "But he has the preferential right. If he wants to - he calls to the akimat, the akimat directly enters into a buyout contract. The cadastral value of the land plot is reduced by 50%, and he is given the right to make payment in installments", - said K. Uskenbaev.
According to Kairat Uskenbaev, 160 districts in Kazakhstan belong to the rural areas, 62 districts assigned to border areas, which are "prohibited for sale to foreigners".
"Now in Kazakhstan there are 100 million hectares of reserve lands. Ideally, these 100 million hectares are to be sold, so that they are in agricultural use", - summed up the vice-minister.
