Decriminalization of pseudo-entrepreneurship will not entail negative consequences

The Deputy Prosecutor General of the Republic of Kazakhstan, Marat Akhmetzhanov, also took part in the IV Congress of NCE RK "Atameken", where he talked about measures to protect business in the criminal process. First of all, he noted the decriminalization of some articles of the Criminal Code of the Republic of Kazakhstan. "The approaches to initiating cases on economic crimes have been changed. They are registered only in the presence of acts of inspections and damage. As a result, the number of economic crimes decreased by 4 times. Amendments have been made to articles of the Criminal Code related to the humanization of criminal offenses in the economic sphere, where the key innovations are the decriminalization of pseudo-entrepreneurship. The size of punishments is reduced for 13 articles of the Republic of Kazakhstan, 6 articles provide for the exemption from responsibility of persons who have committed a crime for the first time, 3 alternative punishments are introduced in the form of multiple penalties", - the Deputy Prosecutor General said. Marat Akhmetzhanov added that the decriminalization of pseudo business would not entail negative consequences, since criminal liability for tax evasion remains. In his turn, Deputy Chairman of the Agency of the Republic of Kazakhstan for State Service and Anti-Corruption Affairs Alik Shpekbayev added that Kazakhstan has a fundamentally new model of combating corruption, built on anti-corruption education, prevention and punishment.
"Kazakhstan is implementing a fundamentally new model of countering corruption, which is built on anti-corruption education and prevention and punishment. One of the key areas of the anti-corruption policy for 2015-2025 is the fight against corruption in the public and private sectors. For the first time, new anti-corruption institutions were established, mechanisms for monitoring corruption risks and forming an anti-corruption culture are being implemented. This year, the National Chamber of Entrepreneurs of the Republic of Kazakhstan "Atameken" takes a special place, as a civil society institution that is a key partner of the agency and contributes significantly to the implementation of anti-corruption policy", - Alik Shpekbayev emphasized. In December 2016, the Road Map was signed between the Atameken and the Anti-Corruption Agency. Since the beginning of this year, an external risk analysis has been conducted in 16 areas most important for business development. "The road map is an important tool for ensuring the protection of the rights of entrepreneurs. And also to identify and eliminate the causes and conditions that contribute to the development of corruption. The results of the work done in each sphere are considered at a conference call with the participation of representatives of Atameken, deputies of the Parliament, state bodies, members of public associations and the media. As a result, additional recommendations are being developed. The participation of deputies provides an objective assessment of the situation in the business environment and the development of specific proposals", - the Deputy Chairman the Anti-Corruption Agency added. According to Alik Shpekbayev, 229 recommendations were made to state agencies to eliminate identified risks, 64 of which were in regulatory legal acts and 36 in organizational and management activities. 29% of the identified risks were related to the imperfection of the law. Recall, the IV Congress of the National Chamber of Entrepreneurs RK "Atameken" is held in Astana. More than 500 delegates, business representatives take part in the Congress.
