There is no need to pay a recycling fee for a temporarily imported car
The Ministry of Energy explained the rule on the absence of the need to pay a recycling tax for an automobile temporarily imported into Kazakhstan. The National Chamber received an appeal from LLP “Beleks Uralsk KZ” with a request to assist in registering vehicles that the Association intended to temporarily import into Kazakhstan (under a lease agreement). The Administrative unit of Police Office of WKR Department of Internal Affairs considered that in order to register even temporarily imported cars, it is necessary to pay a recycling fee for them in advance.
On 27th of January 2016, the Government Decision No. 28 approved the Rules for the Implementation of Extended Obligations of Producers (Importers) (RRP), which stipulate the need to pay a recycling fee, but only for producers and importers. In fact, LLP "Belex Uralsk KZ" is neither a producer nor an importer, since it planned to import vehicles into Kazakhstan temporarily (there is no reason to dispose them on the territory of Kazakhstan, respectively - there are no grounds for paying a recycling fee). The National Chamber of Entrepreneurs has applied for explanations to the authorized body - the Ministry of Energy of the Republic of Kazakhstan. On August 21, 2017, the Ministry of Energy submitted the following reply. According to paragraph 2 of Article 285-1 of the Environmental Code of the Republic of Kazakhstan, the requirements on utilization do not apply to importers in terms of imported vehicles to the territory of the Republic of Kazakhstan and sold beyond its borders. However, in case of decommissioning (in case of an accident or other reasons), the temporarily imported vehicle must be transported outside the RK for disposal.
