Mazhilis exempted VAT for businesses of Baikonur
Members of the lower chamber of the Parliament voted for the settlement of issues of double taxation of indirect taxes
In case of export of goods from the territory of the town of Baikonur to another territory of Kazakhstan or importation of goods from territory of Kazakhstan to Baikonur, goods are subject to value added tax at zero rate and exempt from payment of excise tax on excisable goods. This norm is contained in the draft law "On ratification of the Protocol amending the Agreement between the Republic of Kazakhstan and the Russian Federation on the status of the city of Baikonur, the order of formation and the status of its executive bodies dated by 23rd of December 1995". The draft law was discussed today at the plenary session of the Mazhilis with participation of the Minister of Finance of Kazakhstan Bakhyt Sultanov.
"Today turnover of sales of goods of Baikonur is levied by value added tax. In turn Baikonur (Russian) taxpayers do not have the right to refer the VAT in credit by the Russian legislation and the cost of goods is increased by this amount. In this case, VAT is charged at a rate of 18% by the Tax Code of the Russian Federation ", - said the Minister.
Head of the Ministry of Finance said that a similar situation arises in the "sale of goods on the territory of the Republic of Kazakhstan from the territory of the city of Baikonur", which leads to artificially high prices. "The Minister noted that to solve this problem the Kazakh side "worked together with Russian colleagues", which culminated in the drafting of this Protocol.
"In it we have laid the same principle that works today in the Eurasian Economic Union - during sale of goods from the territory of the Republic of Kazakhstan at the Baikonur, the turnovers are taxed at a" zero "rate and the VAT is collected once in Baikonur at the rate of 18%, and vice versa. The same approach is used for the provision of services and performance of work ", - said the Minister of Finance.
Its ratification is required due to the fact that "the provisions of the Protocol provide for rules other than those established by the tax legislation of the Republic of Kazakhstan".
In the co-report to the draft law, the Secretary of the Committee on International Affairs, Defense and Security of the Mazhilis of the Parliament Irina Aronova also expressed the hope that the adoption of the draft law will have a positive effect. "Now in Baikonur live more than 30 thousand of our citizens, therefore, after the ratification of the protocol they will be able to purchase goods and services at a reasonable cost", - said the deputy.
Irina Aronova also noted that "this Protocol specifies the procedure for collection of indirect taxes in the performance of works and services, as well as determining the place of supply of these works and services".
"Thus, this protocol is amended to allow to define clearly the tax base, thereby to prevent the double taxation of individual entrepreneurs and legal entities of the Republic of Kazakhstan and the Russian Federation, registered in the city of Baikonur.
As a result, the Mazhilismen approved ratification and passed it to the Senate.
