Timur Kulibayev: "The law on pseudo-entrepreneurship should be repealed"
The Chairman of the Presidium of NCE RK said that "Atameken" will insist on repeal of the articles on pseudo-entrepreneurship from the Criminal Code
This topic has become one of the principal at the meeting of the Regional Council of the Chamber of Entrepreneurs of East Kazakhstan region, which was held with the participation of the head of NCE.
EKR - one of the regions where, due to transactions with "pseudo-entrepreneurs" suffer from bona fide entrepreneurs. According to the director of the Regional Chamber of Igor Shatsky, today every third LLP has to pay additional taxes for transactions concluded with "one day companies" for a total amount of 50 billion tenge.
"The situation with pseudo-entrepreneurs threatens bankruptcy of nearly 40% of total registered enterprises in the region", - said the director of the RCE. According to him, all the manufacturers of building materials in the region potentially fall under this provision of the law.
Since the beginning of 2016, NCE has received more than 150 complaints from entrepreneurs from virtually all regions of Kazakhstan (Zhambyl, South Kazakhstan, Karaganda, East Kazakhstan, West Kazakhstan, Pavlodar region and Almaty city)
According to NCE to combat these illegal activities, which are carried out by false companies, this provision should be excluded from of the Criminal Code.
"The law on pseudo-entrepreneurship should be repealed, and we will actively promote this position", - said Timur Kulibayev.
The head of the Presidium of NCE said that pseudo-entrepreneurship was introduced in Kazakhstan in 1997, following the example of Russia. During development of the New Criminal Code in 2014, the developers wanted to repeal this article, but then decided to save it. As a result, "pseudo-entrepreneurship" duplicates other offenses. In fact, this is one of the ways of tax evasion, bank loans, fraud, so it was repealed in Russia in 2010.
"Russian realized that the law does not work in 2010, it was repealed there, but we still use it and the police does not want to abandon it", - said the Chairman of the Presidium of NCE RK.
Timur Kulibayev said that "NCE has already voiced its position at a meeting with the Government, a commission was created under the Ministry of Justice, and “Atameken”, in turn, will insist on repealing the law".
