"Atameken" asks importers of Ukrainian goods to refrain from long-term contracts
On 1st of July this year the presidential decree establishing the rules for the transit of goods from Ukraine to the Republic of Kazakhstan through the territory of the Russian Federation will expire
From 1st of January this year was established a special procedure for the import of Ukrainian goods to Kazakhstan in transit through the territory of Russia. In accordance with the prescribed order the goods from Ukraine to Kazakhstan recipients are moved only through approved border crossing points, in particular the route, as well as under customs escort and the seals on the basis of the GLONASS system.
Over the past period through the route and with the adherence to the rules for movement of cargo determined by the Russia were transported over 400 Kazakhstani vehicles and about 1,500 rail cars. Despite the financial costs related to a new order of import, domestic carriers have faithfully observed the requirements of Russian legislation and according to information of the State Revenue Committee of MF RK since the beginning of the year there was not recorded any violation of the customs legislation by Kazakhstani entrepreneurs during the delivery of goods.
The value of transit through the territory of Russia to Kazakhstan is crucial not only because of the geographical location of our country, but also due to the fact that the Ukrainian counterparties are reliable partners for domestic entrepreneurs with established economic ties. This year alone, there were signed more than 3,000 contracts for the supply of Ukrainian products, the cost of which is about 14 billion US dollars.
Main nomenclature of goods imported from Ukraine are as follows: food products and confectionery, furniture, building materials, industrial products and other goods.
However, the decree loses its force on 1st of July this year However, no official information was provided by the Russian Federation on further conditions of travel of Ukrainian goods through the territory of Russia to Kazakhstan, this fact raises concerns among Kazakhstani businesses, as they fear possible ban of transit of Ukrainian products.
The current legal framework of the Union, in turn, does not imply transit restrictions and special conditions for the import of goods, which are not included in the list of "sanctioned" products.
Thus, in accordance with the Government Decree of RF #778 "On the application of certain special economic measures in order to ensure the security of Russia" on 7th of August 2014 was introduced a ban on the import of certain categories of goods according to the approved list.
According to the logic, with the termination of the decree #1 on 1st of July this year, the ban import on the customs territory of the Union, including transit, should be limited to a list of "sanctioned" goods.
The Chamber, in order to clarify the situation, together with the Government of the Republic of Kazakhstan is working on obtaining official pronouncements about the future algorithm of import through the Russian Federation.
In this regard, NCE RK "Atameken" encourages local entrepreneurs to refrain from entering into further contracts and prepayment until the circumstances and conditions of travel of Ukrainian products throught the territory of Russia will be clarified.

В соответствии со статьей 28 Договора о ЕАЭС в Союзе действует внутренний рынок, в котором обеспечивается свободное передвижение товаров, лиц, услуг и капиталов. В рамках функционирования внутреннего рынка во взаимной торговле государства-члены Союза не применяют ввозные и вывозные таможенные пошлины, меры нетарифного регулирования, специальные защитные, антидемпинговые и компенсационные меры.
Согласно официальным разъяснениям ФТС России запреты и ограничения действуют только в отношении товаров, запрещенных к ввозу в Российскую Федерацию в соответствии с Постановлением Правительства РФ от 7 августа 2014г. №778 «О мерах по реализации указов Президента Российской Федерации от 6 августа 2014г. №560 и от 24 июня 2015г. №320» (далее – Постановление).
Перемещение товаров, определенных в Постановлении, осуществляется в порядке и на условиях, установленных главой 32 Таможенного кодекса Таможенного союза и главой 29 Федерального закона от 27 ноября 2010г. №311-ФЗ «О таможенном регулировании в Российской Федерации».
