Bolat Palymbetov: "General plan – isn’t a secret object, everything should be transparent"
This was stated during the meeting with the entrepreneurs of East Kazakhstan region by the Commissioner for the Protection of the Rights of Entrepreneurs of Kazakhstan Bolat Palymbetov.
As the analysis of complaints of the Regional Chamber of entrepreneurs shows the, most systematic problems of EKR business are problems in the area of tax administration, public procurement, land relations, construction, architecture and urban planning, licensing procedures, etc.
It should be noted that in the East Kazakhstan region, as in other regions of the country, the weak point is land relations. In this regard, representatives of local executive bodies violate regulations of public services in land relations. Business Ombudsman is particularly outraged by actions of local officials, who during issuance of land plots to entrepreneurs, impose on them excessive and often unjustified requirements. So, there are no detailed planning projects for settlements and the possibility of amending the approved detailed planning projects, which creates high administrative barriers for entrepreneurs, since Article 44 of the Land Code prohibits the provision of land for construction without a detailed planning project and (or) construction projects. Meanwhile, the availability of a detailed planning project, as well as the lack of it, can serve as a basis for refusal by the local executive authority to grant or to renew land use rights, as the purpose of the requested land plot may not correspond to the intended purpose, which is provided in the detailed planning project.
There is also a non-transparent system in the process of provision land use rights by local executive bodies, such as, tightened terms of consideration of applications, extension of land use rights. As a result, an entrepreneur incurs enormous costs.
"The general plan - it is not a secret object, everything should be clear and transparent", - said on this occasion the Commissioner for the Protection of the rights of entrepreneurs.
Many questions arose from the local business community about the state’s participation in business activity.
Business Ombudsman, after listening to the problems of representatives of business circles of the region, called on them to participate actively in the discussion of important business laws. According to Bolat Palymbetov, more than 90% of problematic issues can be resolved locally. He also proposed to the Chamber of entrepreneurs to work closely with deputies.
"In maslihats at different levels - more than half of the deputies are representatives of the business community - as your colleagues who are well aware about all the systemic problems of business, you need to use it and to solve the problems on the ground", - said the Business Ombudsman.
As it was stressed by Bolat Palymbetov, during the working trips to the regions, he systematized, analyzed all the questions coming from the businessmen, and the main purpose of the Business Ombudsman - is to bring them to the notice of the leadership of the region and the regional prosecutor.
During a meeting of the Ombudsman with businessmen were announced the results of an independent rating "Business environment", the level of corruption and the shadow economy. As it was stated by the director of the department of public monitoring and working with administrative barriers NCE RK "Atameken" Erbol Ustemirov, East-Kazakhstan region takes the 3rd place in terms of administrative regulation, 12th place - in state support, 14th place – in real estate and infrastructure, 8th – in human resources - and 11th place in financial resources.
The rating "business climate" assessed the level of corruption through the eyes of entrepreneurs.
"According to this indicator the situation in East Kazakhstan region is very good, the area is on the 12th place in terms of the highest level of corruption - said Erbol Ustemirov. - At the same time 69% of respondents believe that the level of corruption in East Kazakhstan region has remained the same, 28% of respondents believe it increased and only 3% think that the level of corruption has decreased".
As it turned out, there are a lot of problems in the business community of East Kazakhstan region. Only within the line of business defense from the beginning of 2015, the regional Chamber of entrepreneurs, according to its director Igor Shatsky, received more than a thousand applications. Half of them have already resolved. The amount of money, which was saved with the assistance of RCE, equals to nearly four billion tenge.
