The farmer didn’t lose his land plot
Thanks to the court ruling, the farmer managed to retain 1525 hectares of land worth 73.7 million tenge in Kyzylorda
This was announced today by the Director of Shieli district branch of the Chamber of Entrepreneurs in Kyzylorda oblast Rysbai Nysanhanov. This result has been achieved in the framework of service support of the business support center.
According to the director of the branch, the head of the peasant farm "Baisynov" applied for legal assistance to the Chamber of entrepreneurs.
The problem was as follows: in 2013 Kyzylorda regional office for control over the land use and protection conducted an inventory of agricultural lands in the area Shieli.
During the event there were revealed cases of misuse of the land, the owner of the peasant farm was warned about it, afterwards the land plot was seized by the authorities.
In order to protect the rights and legitimate interests of the entrepreneur, the consultant of Shieli regional Business Support Center Erlan Kulshykbaev protected the interests of the farmer in the court.
At the court hearing, the consultant of the Chamber of Entrepreneurs was able to prove that the use of the farm land "Baisynov" in compliance with its intended purpose has not been possible due to force majeure.
More precisely, the farmer could not irrigate crops, as the channel "Kamysty-kak", located on the state's balance sheet was in a derelict state. An irrigation canal is not purified since 2008. In addition, a 20-meter chute is destroyed, which runs through the hydro construction. For this reason the farm was not used for intended purposes. However, in 2015, work began on clearing the 43-kilometer canal, which will be completed in 2016.
The consultant of the Chamber showed the court reasoned arguments based on legal norms of the Land Code of RK At the court hearing.
As a result, the entrepreneur managed to retain the ownership of the land of 1525 hectares, worth 73.7 million tenge.
The peasant economy has every opportunity (machinery, seeds needed for planting and labor) for the exploration acreage.
