A lawyer of the legal unit of RCE Diaz Otashbaev helped a businessman Sailau Babibaev to win a resonant case in the court.
The story began back in April of last year with the inspection of the land plot of 0.1045 hectares by the Office for monitoring the use and protection of land plots in the region on its compliance with the intended use purpose. At the time the document stated that the property was intended for serving of a housing complex. According to the state agency, during the inspection, it turned out that the owner had violated the law and used the property for other purposes. An administrative case was initiated in relation to the businessman and he was fined for the sum of 19 820 tenge.
However, the businessman presented at the court, the permit of akimat, to change the purpose of land for serving a housing complex.
"It was decided at the court hearing that by the decision of akimat of Taldykorgan #21-265 dated by April 25, 2016 the purpose of the land plot with an area of 1045 square meters, was changed to maintenance of buildings, structures and facilities. At the time of consideration of the case, it was settled. Under such circumstances, the court decided to reject the claim of the Office for control and protection of land use, and the dispute was resolved in favor of the entrepreneur", - said the lawyer Dias Otashbaev.
