Timur Kulibayev suggested that judges learn more about what the business is doing
For this purpose, the National Chamber is ready to organize meetings with entrepreneurs in all regions
Chairman of the Presidium "Atameken" voiced the initiative at the Forum "Improving the effectiveness of judicial protection of rights and legal interests of business", which was held in the Supreme Court of the Republic of Kazakhstan.
"I think it will be interesting for judges to see how the Chamber of Entrepreneurs works, how our Regional Councils work on the ground. We are ready to arrange for the judges to meet with business, to visit enterprises, so that they understand what our businessmen really face in life, what obstacles arise in their work when interacting with state bodies. In the future, this will allow making informed decisions when entrepreneurs apply to the court", - Timur Kulibayev suggested.
In general, the optimization of courts and the establishment of a three-tiered judicial system have had a positive impact on the activities of Kazakhstani courts, the head of Atameken said. But, for business, any trial is a stress, therefore the National Chamber intends to work with the Supreme Court on the analysis of judicial practice.
"We need to see together what issues are considered in courts most often and what decisions are made by the judges. This will show which points need attention to improve the legislation", - said Timur Kulibayev.
The head of NCE again focused attention on the fact that officials who obstruct business activity, in fact, bear no responsibility, getting rid of warnings. Although for business such an intervention bears financial losses, and in some cases, the collapse of enterprises, which runs counter to the policy of the Head of State and joint efforts to develop mass entrepreneurship. The illegal actions of officials, which led to the closure of business, are causing serious damage to the country's economy.
"If it is proved in court that the official caused harm to the entrepreneur, then it is necessary to apply to him strict measures of influence. I hope that we will expand this practice with the judiciary, this will be a great help for our businessmen", - Timur Kulibayev said.
Within the framework of the current judicial system, Timur Kulibayev suggested introducing a narrow specialization of judges, following the example of international experience. As it is difficult to be a highly professional specialist in various fields - civil, tax, customs legislation. Having a judge with a lot of experience in a specific industry will allow making more balanced decisions.
He also noted that on the basis of the International Financial Center "Astana" it is planned to create an independent court based on the principles of English law and standards, the world's leading financial centers. The International Council at the Supreme Court should become an appropriate platform for the beginning of the analysis of existing issues in its work. Timur Kulibayev drew attention to the need for digitalization of existing processes.
"We asked the government to translate procedures related to the customs code, taxation and so on into electronic circulation the following year, which will eliminate the human factor and reduce the corruption component. This should significantly affect the reduction of litigation. The Arbitration Center at "Atameken" was created specifically for the purpose of resolving economic disputes there, without reaching the court”, - Timur Kulibayev said.
Another mechanism for pre-trial settlement of disputes - the Appeal Commission for Tax and Customs Disputes under the Ministry of Finance of the Republic of Kazakhstan. There are already positive results in his work, so more and more entrepreneurs are asking for help.
At the end of the event, the forum participants got acquainted with the possibilities of the Situational Center of the Supreme Court.
