On July 4, the Head of State, Nursultan Nazarbayev, signed the law "On Making Changes and additions to some legislative acts of the republic on improving the law enforcement system". "Our experience shows that bona fide contractors suffer from the pseudo-entrepreneurship. In fact, if their partner is recognized as a business owner, they are also deprived of the opportunity to continue working.
It is not right. If some company worked not in the legal field, that is, the article "fraud", that's why it is necessary to consider their actions and punish.
The Independent Association of Entrepreneurs has repeatedly raised the issue of excluding an article from the Criminal Code: Fairly honest businessmen who suffered from acts of bad faith have repeatedly addressed us in the Association. Most importantly, everyone has a question: how can they foresee that, for example, in 5 years a company will be recognized by a court as a false enterprise?
I asked such a question the tax authorities: how can I protect myself? So you work with the company, it delivers the products, it's all right, how can you know that after a while it will be charged by the article "pseudo-entrepreneurship"? They answered me, well, you need to meet with the director, talk to him. But what's the point? After all, at that time he was not recognized as a pseudo-entrepreneur.
The exclusion of this article will allow to avoid large fines.
Kanat Yeleusizov says: Several years ago, an entrepreneur appealed to us in the Association, and because of the actions of an unfair partner, a fine of 300 million tenge was imposed on her. "Where does this money come from?" She asked. As a result, the businesswoman could not continue working.
I believe that no sane person will engage in pseudo-entrepreneurship.
