How Akim oppresses a businessman
If not the obstacles created by the state official, now an entrepreneur would get more than 300 thousand tenge of profit
In the center of the village Borodulikha was an old, which has been officially registered in ownership. A budding businessman Marvatzhan Abdrakhmanov has decided to build a modern complex, providing public services on this place.
Having received a permit in the rural akimat from the predecessor of the current akim of the village to demolish the house, Marvatzhan began construction of its business.
"In early autumn 2016 I received a construction project, expert opinion on the project and began construction. But did not know that you need to get a ticket and a notification on the beginning of construction at State Architectural Department",- says Marvatzhan Abdrakhmanov. - The rural akimat did not say anything, when it issued the permission for the demolition.
After the appointment the new akim wrote a letter to the Gask, to fine the entrepreneuer for breach and the start of construction without coordination and without changing the purpose of land.
"In the district court, I pleaded guilty, explaining that I have committed the offense unknowingly, the court appointed a penalty, and I paid for it", - says Marvatzhan.
To get a permission at State Architectural Department, you need to change the purpose of land.
The budding businessman simultaneously collected documents to change the purpose of land.
On 30th of September the entrepreneur received the opinion of all the members of the commission, but Akim refused to sign it. As a result district Akim signed it, and the purpose was changed.
After that, the village Akim immediately filed two lawsuits in the District Court. The first on the recognition of the construction as illegal, since it was carried out without changing the purpose of land and without other permits.
The second claim on immediate cessation of the construction. In support of the first claim the construction was stopped.
"On 12th of December at the District Court was held a trial, where the judge decided the executive authority in the face of akim infringes my rights", - said the businessman.
The rural Akim did not calm down, and appealed to the Regional Court, which on 9th of February 2017 left the decision of the district without changes.
"Today, the entrepreneur has already spent more than 4.5 million tenge, and if not for the obstacles, which have been created by the Akim, then today he would have received more than 300 thousand of profit", - commented the director of the branch Borodulikha district of RCE of EKR Sergey Kharchenko.
According to Abdrakhmanov, during 7 months the akim of the village in order to prevent to develop his business has sent one letter to the district department of architecture, 2 letters to State Architectural Department, 2 letters to the district State Revenue Department, 1 letter to the District Akimat, 2 lawsuits in the District Court, 1 appeal to the regional court.
"He does not consider the decision of the district akimat, casts doubt on the experience and competence of State Architectural Department, competence of the experts appointed by the construction company, with which was signed an agreement on construction. It is illegal to interfere in business, looking for any possible prohibition for doing business", - says the businessman.
"Should a real Akim act like that? should he not provide assistance to me as an entrepreneur or just as a resident of this district? I am sure that Akim of our village Murat Argumbaev will not rest on this and will look for other excuses to harass me", - commented Marvatzhan Abdrakhmanov.
