The other side of security: how should the arms business be?
Since January 2017 came into effect the amendments to the law on the location of gun shops
The representatives of Kazakhstani weapon association "Koramsak" addressed to the National Chamber of Entrepreneurs "Atameken" of the Republic of Kazakhstan for assistance in determining the mechanism of implementation of the amendments to the law "On state control over the circulation of certain types of weapons", which came into force on 6th of January this year. In this regard, NCE organized a meeting of weapon business community and representatives of the Ministry of Internal Affairs on its platform.
"The law says that the weapon shops should not be inside housing buildings. With stores located in repurchased flats, it is all more or less clear, but there are questions to the shops in the vicinity of residential homes, or having a common wall with a residential home, but which are not residential housing object. We consider it necessary to conduct a monitoring of all shops licensed to trade civilian and service weapons as soon as possible in order to identify compliance or non-compliance since the law came into force", - said the Vice President of the Association Sergey Katnov.
According to him, representatives of the arms business were given an 18-month deadline to bring their stores in accordance with the requirements of the law and many companies are unaware – should they move to other premises or not. "Since moving is costly, we believe it is important in order to save the industry to bring in advance the information to the companies, working in the sphere of circulation of civilian and service weapons", - said Katnov.
Meanwhile, in Aktobe local authorities already require gun shops to move out to other premises. However, there is a following question: where to move out to, and what premises comply with the new requirements?
"According to our data, out of 103 operating companies, approximately 40 should move out and approximately 20 percent in the boundary condition. We are talking about 55-60% of the subjects of the industry", - said the vice-president of the association.
Head of licensing and permitting control of the Committee of administrative police of MIA RK Nurtay Sartayev recalled that the order for adoption of discussed amendments was given at the Security Council by the Head of State, and upon adoption the law was agreed with accredited associations and the business community.
"Today, we are planning to hold a working meeting with the Ministry of National Economy, and in the coming days, we will define solutions. The Interior Ministry is not authorized to decide on the qualification of buildings. According to the results of the working meeting, our subdivisions will be informed and will notify accordingly the stores that do not comply with this rule", - he said.
Deputy Director of the Department of Small and Medium Business of NCE Irina Tyugina suggested that entrepreneurs do not wait for the decisions of state bodies on the definition of competences and today proactively write letters demanding to decide on each facility, as there are only 111 shops, selling civilian and service weapons in the whole of Kazakhstan.
"In my opinion, each subject shall send a letter to the license body with a request to conduct an audit of each shop for compliance with the new qualification requirements. Then the state agency will have 30 days to respond to each individually and reasonably. Let the state authorities, both central and local, understand each other, who will determine whether the shop meets the requirements. You have a right within 30 days to demand a definite answer and already on this basis to take the administrative decision ", - she said.
