During a press breakfast, the lawyers told reporters about the results of the work for 9 months of this year, responded to the interested questions, citing examples from professional practice.
Deputy Director Valentina Gerashchenko, anticipating questions, noted that the administrative barriers are still one of the factors, hindering the development of business, and she named one of the brightest and most obvious examples.
An individual entrepreneur T. Ospanov for a long time can’t change the purpose of land. She provides services of funeral bureau for 15 years. To this end, she has acquired a land plot, on which the destroyed house is located. Clearing the area, the entrepreneur has established temporary facilities from containers with the help of which, she has set up her business. Moreover, at the request of the Department of Architecture and Urban Planning, the business woman took care of the territory; she painted it and plated with steel sheets the available equipment.
In 2015, by the results of an inspection by land inspection service, she was brought to administrative responsibility for the misuse of the land plot. The businessman appealed to state department of land relations, where officials sent her application for approval to the Department of Architecture and Urban Planning. In response, the authority stated that in accordance with the general plan, the object... falls into the zone of green spaces and public facilities. However, Ualikhanov street on which the facility is located, is full of same commercial facilities. It is a shopping street.
According to the architect of the city Ilua Abenov, it is planned to make a plan of detailed planning, according to which is planned the change of the purpose of the above-mentioned block under the commercial facilities.
Further more. The regional Department for control over the use and protection of land filed a lawsuit against the businesswoman on seizure of land. However, a claim was withdrawn later because of the proceedings and the facts proved by the experts of department on protection of the rights of entrepreneurs and reduction of administrative barriers.
The issue, according to Valentina Gerashchenko, appealing to the norms of the Entrepreneurial Code remains open.
Speaking to reporters, the head of the Department on protection of rights and reduction of administrative barriers prrav Syzdykov Rasul noted that often RCE acts as a mediator between the two business entities. In particular, due to the mediation of the Chamber the issue with one of the famous automobile brand dealers on repairs of a car of a businessman, who carries out freight transportation has been resolved.

At present, the absence of a clear, transparent framework in this sector creates barriers for entrepreneurs and carries the corruption risk in the provision of preferences to the service provider (operator for distribution of fuel).
Currently, according to Valentina Gerashchenko, entered into force rules and criteria for determining the regional operators for distribution of petroleum products, for which is applied state regulation of prices. According to them, under the Regional Akimat is created a commission that will determine the regional operators, but this document will not solve all problems, and the issue of distribution of fuel and lubricants among retailers is still relevant.
In general, since the beginning of the year, the Chamber received 344 appeals within the line of business protection, of which 191 were resolved positively. A third of them – are appeals of entrepreneurs, who for a long time can’t solve the problem of allocation of land plots for construction, obtaining the right for installation of a billboard on a land plot, the reconstruction of an existing object, and other issues in the sphere of land relations, architecture and urban planning.
