For two and a half years, the Chamber of Entrepreneurs of EKR saved 9.5 billion tenge for businesses

A link between business and government appeared in EKR in 2014, which became the main lever of the entrepreneurs.

 What work has been done by the Chamber of entrepreneurs during these 2.5 years, was it possible to solve the problems of regional business?

"From 2014 to the present day the Chamber of entrepreneurs received 1781 appeals within the line of protection of rights and legitimate interests of business, 1357of them were solved positively,  totaling more than 9.5 billion tenge”, - noted the deputy director of the Chamber of Entrepreneurs of East Kazakhstan region on legal affairs Dinara Mukhamedzhanova.

According to her, most often the received appeals are regarding land relations, public procurement, tax relations, monopolies, competition and tariff setting, licensing procedures.

According to the deputy director of RCE, the Chamber of entrepreneurs initiated the use of practice to change the measure of restraint in the form of bail. Previously, the practice was not applied in EKR.

"It is important for every entrepreneur feels comfortable in a business environment. Everything must be transparent and without red tape. In business, there are many problems faced by entrepreneurs, with which they can’t deal on their own", - says Dinara Mukhamedzhanova.

One of the clearest examples of real help to businesses is the problem of LLP "BK Bacon".

In 2013, the Department of Ecology accrued fine on LLP "BK Bacon" for environmental damage in the amount of 460 095 435 tenge – placement of pig manure on the ground for 3 years, and in turn, the tax authority imposed a fine for the non-payment of environmental emissions in the amount of 55 520 454 tenge.

"At the initiative of the Regional Chamber of Entrepreneurs the issue was discussed at the Council for the Protection of the rights of entrepreneurs with the participation of the regional prosecutor. The prosecutor's office supported entrepreneurs at the next court session and explained the rules of the current legislation. The Court of Appeal handed down a reasoned decision. As a result, the amount of the fine amounted only to 1 million tenge", - said Dinara Mukhamedzhanova, adding that there are a lot of positive results. According to her, the Chamber of entrepreneurs is ready to render all possible assistance to entrepreneurs in the protection of rights and legal interests.

Deputy Director of RCE stated that today the most urgent issue is the additional charge of VAT on transactions with the companies in respect of which were conducted pre-trial investigations on the fact of pseudo-entrepreneurship.

It is worth noting that this issue is on the special control of EKR. The amount of accrual of counterparties is about 50 billion tenge. At the same time the withdrawal of the amount of the turnover of enterprises will lead to bankruptcy of the counterparty, which makes up to 80% of the region's business.

"The state and law enforcement agencies conducted a lot of work to identify such operations. In our view, given the current economic situation in the country, this work is organized in an untimely manner by public authorities, who do it to excesses. Our task - in this situation is to protect the bona fide contractors", - concluded Dinara Mukhamedzhanova, adding that through the statements of RCE on criminal proceedings, officials are held accountable.
