Kazakhstan and Kyrgyzstan discuss the draft agreement on trade for certain goods

The Ministry of Economy explained the provisions of international treaties with regard to customs duties when exporting goods from Kazakhstan to Kyrgyzstan

As of 12th of January, 2014 between Kazakhstan and Kyrgyzstan is applied the Agreement on free trade zone within the CIS dated by 18th of October 2011. To the extent, which is consistent with the agreement, the Bilateral Free Trade Agreement between the two countries dated by 22nd of June 22 is apply as well.

At present, the Kyrgyz Republic is a full member of the Eurasian Economic Union. So, from 12th of August 2015 the customs control on the Kazakh-Kyrgyz border was abolished.

In accordance with paragraph 3 of Article 28 of the Treaty on the EAEU within the frames of the internal market in the mutual trade in goods, Member States do not apply import and export customs duties (other duties, taxes and charges having equivalent effect), non-tariff measures, special safeguards, anti-dumping and countervailing measures, except in cases provided for by the Treaty on the EAEU.

At the same time, in accordance with paragraph 12 of the Protocol on the organization, management, operation and development of common markets of oil and petroleum products (Appendix 23 to the Treaty on the EAEU) in the period before the entry into force of an international treaty on the formation of common markets of oil and petroleum products of EAEU, provided for in paragraph 3 article 84 of the agreement, the bilateral agreements, which were concluded between Member States in the field of oil and oil products, determination and order of payment of export customs duties (other duties, taxes and charges having equivalent effect), are applied, if the Member States agree otherwise.

Currently, there is no bilateral agreement in the field of oil and oil products between the Republic of Kazakhstan and the Kyrgyz Republic.

In addition, according to the Ministry of Foreign Affairs of the Republic of Kazakhstan, a bilateral protocol on exemptions from free trade regime to the Agreement dated by 22nd of June 1995 was repealed on 6th of May 1996.

In addition, it is reported that at the present time in order to ensure the economic interests of Kazakhstan, MNE RK and the Ministry of Economy of the Kyrgyz Republic discussed the draft Agreement between the Government of the Republic of Kazakhstan and the Government of the Kyrgyz Republic on trade for certain goods.
