The notification of an illegitimate nature
Thanks to the assistance of the Regional Chamber of Entrepreneurs, an entrepreneur managed to save 200 thousand tenge
The department of land relations of Aiyrtau district of North-Kazakhstan Region tried to blame an entrepreneur in unauthorized occupation of land, thus, creating a need to purchase the specified area.
In October, the head of the farm "Arman" Askar Esenzhanov received a notification from the state enterprise "The department of land relations" of Aiyrtau district, pointed out the violation of the Article 43, paragraph 10 of the Land Code of Kazakhstan, committed by the farmer, namely, unauthorized occupation of land.
"The authorities have recommended the head of the farm to prepare legal documents for an additional land plot for storage of equipment. At the same time, they didn’t propose lease of land, but a purchase of 10 acres of land for 200 thousand tenge. In case of failure to meet this recommendation, they threatened to send inspectors of the land inspection”, - says the director of the local branch of RCE of NKR Daniyar Kalimov.
The appeal of an entrepreneur was reviewed in conjunction with the district prosecutor's office. In the course of the inspection, carried out by the law enforcement agency, it was revealed that the presented notification was unreasonable, as a result SE "the department of land relations" had to withdraw it. Thus, a branch of the Chamber protected the rights and legitimate interests of an entrepreneur in the amount of 200 thousand tenge.
"I appealed to the Chamber of Entrepreneurs, knowing that there are qualified professionals who can not only listen to my story, but also those who can react right away. The notification was canceled, I'm happy and once again I would like to express my gratitude to the Chamber", - says the head of the farm "Arman" Askar Esenzhanov.
